XIII. SUSPENSION PROCEDURES
`Olelo clients have access to a wide range of valuable services and
resources to create non-commercial programming for the communities of
O`ahu. In exchange for use of services and resources, clients agree
to comply with `Olelo’s stated requirements. Valuable access resources
can only remain available and in good condition if all clients agree
to certain standards of care and conduct. If these standards are not
kept, everybody loses. One way to ensure that `Olelo resources are regularly
accessible to clients and to ensure resources are used for the purpose
they are intended is to articulate specific items that are required
when accessing these resources.
Inability to agree to these conditions constitutes a violation of trust
in the use of these resources. These procedures and list of major and
minor violations are not exclusive and do not limit `Olelo’s discretion
to suspend or bar any person from its premises or from the use of its
equipment for any reason. It is hoped that no one will willingly violate
this trust.
A. What is required?
1. Proper use and care of access services, resources and equipment
2. Utilizing access services, resources and equipment for the intent
for which they are provided
3. Treating staff, other clients and guests with respect and courtesy
4. Actively seeking to ensure the safety of `Olelo’s clients, staff,
and facilities
B. What constitutes a major violation?
1. Abusing or vandalizing equipment and facilities
2. Damaging equipment through carelessness and/or misuse
3. Retaining equipment beyond a scheduled reservation due to theft
4. Using equipment and facilities for a purpose not related to production
of a program for PEG access cablecast
5. Reserving or checking out equipment or facilities for use by a non-certified
producer or for a producer, or technician on suspension
6. Repeatedly breaching any of the Statement of Compliance warranties
7. Creating a program to promote or benefit a commercial business and/or
where the sponsors has direct interest in the content of the program
(i.e., Blatant Commercialism)
8. Harassing, threatening or using abusive behavior or language toward
staff and/or another client (see Client/Staff/Facility Safety Section
of these operating procedures for more specific sanctions that may apply
to this violation)
9. Possessing or bringing onto `Olelo’s premises and facilities (including
remote production locations) firearms, knives, weapons, explosive materials,
and/or biological hazards
10. Possessing and/or consuming alcohol or illegal drugs on `Olelo premises,
facilities and remote production locations
11. Misrepresenting oneself as an employee of `Olelo
12. Damaging equipment by adding or reconfiguring equipment with out
prior staff approval
13. Repeatedly committing minor violations (see minor violation sanctions)
14. Reserving or checking out equipment for another producer or technician
unless specified and approved in advance.
C. What constitutes a minor violation?
1. Failing to cancel reservations in advance of scheduled use (no show)
2. Returning equipment late without prior extension by an authorized
staff member
3. Remaining in the studio, screening room or editing facilities beyond
the scheduled reservation without an extension by an authorized staff
member
4. Returning equipment that is dirty
5. Leaving trash or debris in the studio or editing facilities, lokahi,
classroom, lobby, or screening room
6. Submitting a program without proper disclaimers and contact information
7. Breaching any of the Statement of Compliance warranties
8. Committing any other infraction of the Policies and Procedures
9. Minor commercialism violations where the program in question contains
information about a commercial business, products or services that are
incidental to the overall content of the program. This can consist of,
and is not limited to, calls to action, qualitative statements and contact
information for the business
10. Using profane language used in an offensive manner in the presence
of an `Olelo employee and/or another client on the `Olelo premises or
on a remote production location
11. Engaging in disruptive or intrusive behavior on `Olelo premises
that interferes with smooth operations and/or staffs work or other clients
12. Having food or beverages in the edit bays, computer workstations,
studio and/or control room
13. Using equipment or facilities without prior authorization or scheduled
use
14. Adding or reconfiguring equipment without prior staff authorization
15. Being in unauthorized area(s)
16. Providing false or misleading information to staff
17. Refusing to adhere to staff directives
18. Utilizing resources, and a program is not delivered for `Olelo cablecast
(if in `Olelo's judgement, program submissions are disproportionate
to equipment use, the producer may be required to provide staff additional
information prior to any additional resources being made available to
the producer)
C. What happens when a violation occurs?
1. Major violations. A major violation results in immediate suspension
from use of equipment and facilities for a minimum period of one year.
Where commercial use fees are assessed, or damage to or loss of equipment
and/or facilities occurs, a suspension will remain in effect until full
compensation is made, which ever is longer. There are no mandatory written
warnings prior to suspension in cases of Major Violations.
Repeat of major violations, possession of weapons or firearms on `Olelo
premises, and/or any violence toward another client, staff member or
other person on `Olelo premises or on a production location will result
in long term or permanent suspension from all rights to use `Olelo equipment
and facilities. Reinstatement of privileges in such extreme cases will
be at the discretion of the Chief Executive Officer.
2 .Minor Violations. A Minor Violation will result in the following
actions:
a. Verbal warning for the first Minor violation, staff to document incident
in client file
b. Written warning for the second Minor violation
c. Suspension from equipment and facilities for the third Minor Violation
Minor violations will be tracked on a two-year rolling calendar basis.
A client with three minor violations within the two-year period will
be suspended for 30 days. A client with four minor violations within
the two-year period will be suspended for 60 days. A client with five
or more minor violations within the two-year period will be suspended
for 6 months. For any client with five or more minor violations, the
Chief Executive Officer shall have the discretion to require that client
to obtain re-certification prior reinstatement. Staff will file a written
report on any suspension.
If a client disagrees that he/she has committed any of the above violations
or that a suspension is appropriate, the client may appeal the violation
or suspension as outlined in the appeal procedures.
