XII. CLIENT/EMPLOYEE/FACILITY SAFETY
A. Policy Goals and Objectives
The objective of this policy is to achieve the following:
1. Reduce the potential for violence in and around `Olelo's premises
and off-site production areas;
2. Encourage and foster an environment that is characterized by respect
and healthy conflict resolution; and
3. Mitigate the negative consequences for employees and/or clients who
experience or encounter violence, while on `Olelo's premises.
B. Policy Statement
`Olelo is committed to maintaining an environment free from violence,
threats of violence, harassment, intimidation, and other disruptive
behavior. `Olelo refuses to tolerate violence in its facilities and
will make every effort to prevent violent incidents and protect its
employees and clients.
Violence, threats, harassment, intimidation, and other disruptive behavior
at `Olelo's facilities (including van and other EFP shoots) will not
be tolerated; all reports of incidents will be taken seriously and will
be dealt with as `Olelo's management deems appropriate in its sole discretion
(without guaranteeing anyone that it can prevent incidents of violence
or other disruptive behavior). Such behavior can include oral or written
statements, gestures, or expressions that communicate a direct or indirect
threat of physical harm. Individuals using `Olelo's facilities who commit
such acts will be subject to discipline including, but not limited to,
a permanent bar from using `Olelo's facilities, suspension, or conditional
use of the facilities (e.g., restricted access to `Olelo's facilities,
restricted communications with `Olelo's staff). `Olelo's Chief Operations
Officer shall have the discretion to determine what measures are appropriate
to protect employee and client safety. The Chief Operations Officer's
decision with respect to employees and client safety restrictions is
not appealable.
If a client disagrees with the Chief Operations Officer's action, the
dispute shall be referred to binding arbitration to Dispute Prevention
and Resolution ("DPR"). Costs of the arbitration shall be shared equally
by the client and `Olelo, paid in advance. Each party will be liable
for his/her/its own legal fees.
